1. About these terms
Clearalist (“Clearalist”, “we”, “us”) is an email list verification service. These terms apply to your use of clearalist.com and app.clearalist.com (the “Service”). By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. If you use it on behalf of a business, you confirm that you are authorised to accept these terms for that business.
2. Your account
- Give accurate details when you sign up, and keep them up to date.
- Each person may have only one account. Creating more accounts to collect extra free credits is not allowed.
- Keep your password confidential. You are responsible for everything done through your account. Tell us at [email protected] straight away if you think someone else has accessed it.
- You may not sell or transfer your account.
3. Credits
- One credit verifies one email address.
- Analysing an uploaded list is free. This includes removing duplicates and detecting addresses with no mail server, disposable addresses, catch-all (accept-all) domains and addresses that cannot be checked. Credits are charged when you clean a list, one per address we will check at mailbox level. We deduct them before the check starts.
- If a mailbox check ends without a definite answer, for example because the mail server times out or asks us to retry later, that credit is returned to your balance automatically.
- A single-address check uses one credit unless we cannot reach a result.
- Credits bought as a one-time purchase never expire.
- Lifetime plans (no longer sold) give a monthly allowance that resets every 30 days. Unused allowance does not carry over. Credits bought separately as a one-time purchase are not affected by the reset.
- Free, bonus and promotional credits are a courtesy. We may change or withdraw them, and they can never be exchanged for money.
- Credits have no cash value and cannot be transferred, sold or shared between accounts.
4. Prices and payment
- Prices are in US dollars and are shown on our pricing page. A price change does not affect credits you have already bought.
- Payments are processed by PayPal. We never see or store your card details. PayPal shares the payer’s name, email address and country with us. We also record the IP address used to place the order. We use this information to process your order and to prevent fraud.
- You may only pay with a PayPal account or payment method that you are authorised to use.
- Credits are added to your account as soon as PayPal confirms the payment. At that point we have delivered what you bought.
- To prevent fraud, new accounts can only buy plans up to a certain size, and up to a total amount, until their first payment is 30 days old. The app shows the current limits when they apply. We may refuse or cancel any order we reasonably suspect is fraudulent or unauthorised.
5. Refunds
- Unused purchases: you can ask for a full refund within 14 days of a purchase, as long as you have not used any credits since that purchase. Email [email protected] with your PayPal transaction ID. We refund through PayPal to the original payment method.
- Used credits are not refundable. Once credits have been used, the verification work has been done and the results delivered.
- Result quality: if you believe results were wrong, contact us with the list ID. If we find a fault on our side, we will correct the list or return the affected credits to your balance.
- Free, bonus and promotional credits are never refundable.
6. Chargebacks and payment disputes
- Please contact us before opening a dispute. We can usually sort out a problem faster with a correction or a refund under section 5.
- If you open a dispute or chargeback for a purchase whose credits were delivered, we will give PayPal or your bank the records of that purchase and of your account. These include your account details, order and payer details, IP addresses, uploads, credit usage and delivered results.
- While a dispute is open, we may suspend your account and freeze its remaining credits, including any bonus credits. If the dispute is decided against us, we may close the account and remove any credits left in it.
- If we believe a payment was made with a PayPal account or payment method you were not authorised to use, we may report it to PayPal and to the relevant authorities.
7. Acceptable use
You may only upload email addresses that you collected lawfully and have the right to process. For example, addresses from people who signed up with you or from your own customers, handled in line with the laws that apply to you, such as GDPR and CAN-SPAM. You must not:
- verify purchased, rented, scraped or harvested lists;
- use the Service or its results for spam, phishing, invoice or payment fraud, impersonation, or any other unlawful or deceptive purpose;
- create multiple accounts, or otherwise get around credit, purchase or usage limits;
- interfere with the Service, overload it, probe it, or try to access systems or data that are not yours;
- reverse engineer the Service, or resell it without our written permission.
If we reasonably believe an account breaks this section, we may suspend or close it and remove its remaining credits. We will not issue a refund in that case.
8. Your data
- You keep ownership of the lists you upload. We process them only to provide the Service to you. We do not sell or share them.
- Your uploaded file and its results are kept until you delete the list. Deleting a list removes its file.
- To improve speed and accuracy, the verification result for an individual address is kept for up to 30 days. That result may be reused if the same address is checked again in that time. Only the address’s status is reused, never your list or your identity.
- Technical logs of mail server responses are kept for up to 30 days to diagnose problems.
- We look at uploaded data only to provide support, fix problems, investigate abuse, or improve accuracy.
- We use Amazon Web Services for hosting, storage and email, and PayPal for payments.
- Our Privacy Policy explains how we handle personal data and your rights over it, including under GDPR.
9. Results and accuracy
Verification results are our best assessment of each address at the time it was checked. Mail servers can give incomplete or misleading answers. For example, catch-all domains accept every address, and some servers block or delay checks. Addresses also change over time. We do not guarantee that an address marked valid will accept your email, or that one marked invalid would reject it. You are responsible for how you use the results.
10. Availability and changes to the Service
We aim to keep the Service running, but we do not guarantee it will always be available or free of errors. Processing times depend on list size and on the mail servers we contact. We may change, add or remove features at any time.
11. Suspension and closing your account
- You can close your account at any time by emailing [email protected].
- We may suspend or close an account for a breach of these terms, suspected fraud, a chargeback, abuse, or where the law requires it.
- If we close your account when you have not broken these terms, we will refund any purchased credits you have not used.
12. Intellectual property
The Service, its software, website and branding belong to Clearalist. We give you a personal, non-transferable right to use the Service under these terms. Nothing in these terms transfers any of our rights to you, or any of your rights in your data to us.
13. Disclaimer and limitation of liability
The Service is provided “as is” and “as available”, without warranties of any kind, as far as the law allows. As far as the law allows, we are not liable for any indirect or consequential loss, such as lost profits, lost data or damage to your sender reputation. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some countries do not allow these limits. Where that is the case, they apply only as far as your local law permits.
14. Indemnity
You agree to cover any claims, losses or costs, including reasonable legal fees, that result from your breach of these terms, from the data you upload, or from how you use the results.
15. Emails from us
We send emails you need in order to use the Service, such as account verification, password resets, payment receipts and list-completed notices. We may also send occasional product news. You can unsubscribe from those at any time using the link in the email.
16. Changes to these terms
We may update these terms. We will post the new version on this page with a new “Last updated” date. If a change is significant, we will also email you. If you keep using the Service after a change, you accept the updated terms.
17. Governing law
These terms are governed by the laws of India. The courts of Bhopal, India, will handle any dispute. This does not remove any protection you have under the mandatory consumer laws of the country where you live.
18. General
If part of these terms is found unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. These terms, together with our Privacy Policy, are the whole agreement between you and us about the Service.
